Only natural persons who have reached the age of sixteen and reside in Germany are eligible to participate. The actual place of residence of the participant is considered as residence. Information about the person and the place of residence must be provided correctly and truthfully and must be provided to one of the operators on request.
There is no legal entitlement to admission to RYDES. The operators can refuse admission to participate in RYDES without stating any reasons.
Use of the app requires registration. Registration takes place directly through the app using the free sign up feature. For this, a freely selectable user name and a valid e-mail address and a password must be specified. For the registration we use the so-called double opt-in method. The registration is only completed when it has been confirmed via a link, which we send in a confirmation e-mail to the specified e-mail address. If a confirmation has not been confirmed after seven days, the registration is automatically deleted from our database. Alternatively, you can sign up with a Facebook account via "Facebook Login" or with a Google Account via "Google Login". Only one account may be created per person.
The user account can be deleted at any time by sending us a request to firstname.lastname@example.org. You will then receive a confirmation from us via e-mail. In this case, all data provided during registration, including the accumulated points, will be permanently deleted. The usage data incurred during the use of the app will also be deleted or completely anonymized.
After registration, the app allows the participant to upload selected tickets from mobility operators (see mobility operators list), allowing the participant to collect points. This is possible by uploading the ticket, forwarding the booking confirmation or scanning the QR code. A ticket can be uploaded once purchased and up to 30 days after the start of the trip. Points can only be credited to the personal user account for services used by the participant himself. When claiming benefits from the RYDES partner companies, the beneficiary must be the RYDES account holder in order to be credited points. The bill recipient is irrelevant. One point is credited per actual kilometre covered. The number of kilometres travelled determines the app by means of the start and end of the used means of transportation. For technical reasons, the distances determined by the app may differ from the actual kilometres covered. There is not entitlement to adjustments. The participant receives points for every valid ticket of the listed mobility providers (Cf. list of mobility providers) that fulfills the following criteria: - the start and end point on the ticket are located in Germany (excluding flights) - on the day of the ticket upload the trip is either a future event or not more than 30 days have passed since the start of the trip - the name on the ticket is the same as the account name in RYDES - the trip is longer than one kilometre - the ticket complies with the required ticket format (type of ticket and is digital) The participant does not receive points if: - the daily point limit of 5000 points is reached - the participant has already successfully uploaded 10 tickets within the last 24 hours - the same ticket has been uploaded before - the ticket has not been used - the ticket has been used by someone else than the participant Points are also awarded for the successful recommendation of the app via e-mail, SMS or other messenger or social media services installed on your device. The number of each credited points per recommendation can be viewed at any time through the app by clicking on the info icon in the score display. Changes will be notified by push message.
It is the duty of the participant to manage his tickets in the app and thus, to make sure that only tickets that actually have been used by the participant, are used. The participant is required to report unused or cancelled tickets via e-mail within 14 days after cancellation and to instruct RYDES with the deletion of the ticket. It is not allowed to spend points that have been received for unused or cancelled tickets. The current balance can be retrieved at any time via the app.
Each participant can redeem their credits at participating affiliates as soon as the number of points required for each reward has been earned. Prerequisite for the redemption is the availability of the rewards and the required number of points earned. The respective bonuses offered, and the number of points required to redeem each are displayed via the app. A conversion and / or payment of points in cash is not possible. The rewards may be obtained from an operator, co-publisher or RYDES affiliate, depending on the particular reward. The redemption of a reward cannot be combined with other loyalty programs and discounts. After the redemption period, the reward voucher expires and can then no longer be redeemed. Each credited reward can only be redeemed once. As soon as the required number of points has been reached for the selected reward, another reward can be redeemed. The availability of rewards may vary by date and season. Individual rewards may not be available at certain times. Certain rewards can only be redeemed in certain regions due to the residency and activity of the RYDES partner companies. This is indicated before the selection of the premium. The availability or quality of the rewards provided by RYDES affiliates will be beyond the control of the operator or a co-publisher. Neither the operators nor the respective co-publisher is therefore responsible for the availability of the services of other RYDES partner companies and the proper performance of the contract. The general terms and conditions of the respective RYDES partner company apply to these services.
If points are not redeemed for a bonus within 36 months of the start of the journey, they will be forfeited by the end of the next quarter.
The app itself and the content made available through it are protected by copyright or other protective laws. These rights must be observed and, in particular, company and product labels as well as trademarks and copyright notices removed.
The operators reserve the right to discontinue RYDES at any time and to terminate the loyalty program. In this case, all collected points forfeit automatically. The same applies in the case that RYDES is replaced by another program.
The app may contain hyperlinks to third party websites. We assume no responsibility for the content of these websites, nor do we make them our own. A check of the linked third-party content is not reasonable for us without concrete indications of an infringement and does not take place. Upon notification of violations, however, we will immediately remove such links and / or immediately block the corresponding third-party content, insofar as this is technically possible with reasonable effort.
For damage caused to participants in connection with their participation by an operator, a co-editor or the respective vicarious agents, the following applies In case of intent or gross negligence as well as in the presence of a guarantee the liability is unlimited. In case of slight negligence, the liability in case of injury to life, body or health is also unlimited. In the event of a slightly negligent breach of essential contractual obligations, the liability is limited to property and pecuniary losses attributable thereto in the amount of the foreseeable, typically occurring damage. An essential contractual obligation is the obligation whose fulfillment makes the proper execution of the contract possible in the first place and on the compliance of which the participant may regularly rely. Any further liability for damages is excluded except for claims under the Product Liability Act.
German law applies. If the participant may assert claims, the court of jurisdiction is Berlin. In addition, a participant may also be prosecuted at its general venue or any other jurisdiction venue. The operators are not obliged to participate in a conciliation procedure and cannot offer to participate in such a procedure.
